Arun Letter re a Swiss Government Decision

Below is a copy of a letter that SN has received  from Swami Arun in Nepal.

It is difficult to make out what import in actual reality this Swiss decision will effect.One imagines such a decision is likely to be subject to appeal, it would be in the UK, and likely to be appealed by those seeming to fail the “Commission of Vigilance” standards.

The way the letter has been phrased seems  too triumphal to SN. In addition Arun seems to have labelled people fascistic without giving them any right of reply.  Anyway we publish it here as clearly it is newsworthy, and our own readership tends to be sceptical and street wise and will be quick to see any flaws in the judgement if they exist.

We have a good news for all Osho lovers and sannyasins throughout the world.

On the 2nd June, 2014, the Commission of Vigilance for Foundations, a body of the Ministry of Internal Affairs of the Swiss Government has removed the entire board members of Osho International Foundation (OIF).
The ex-members are: Michael O’Byrne (Michael Byrne) or Jayesh
John Andrews or Amrito
D’Arcy O’Byrne or Yogendra
Klaus Steeg or Pramod
Rudolf Kocher (Swiss Citizen)

All the bank accounts of OIF have been frozen and the members have been issued an official warning NOT to sign any more documents on behalf of OIF, nor to act in any way as representative of OIF.
The Swiss Government has appointed a lawyer as the Official Government Administrator of OIF.

This means that ex-members of OIF are not responsible anymore and should not have any further dealings with anyone on any matter, including signing contracts, dealing with publishers, Facebook, YouTube, etc., nor are they allowed to deal on behalf of OIF with any Sannyas centre or individual sannyasins, trying to impose their fascistic policies as they have been doing up until now.

In the next few days, we will send you an English translation of the official decision of the Swiss Government, so that everyone can find out the details and understand for themselves.We will also tell you more details in regards to the process that has led to the removal of the entire board members of OIF.

This is a great historical decision and a stepping stone towards freeing Osho and his legacy from the fascist regime of the dictatorial group that was damaging Osho’s work and discouraging all Osho lovers who were genuinely and honestly trying to spread Osho’s vision. We are all aware that they have closed hundereds of Osho establishment’s around the world and have banned thousands of his intimate and dedicated disciples from entering into the Pune Ashram. The fabricated threat that had been imposed by OIF on the basis of fake copyrights and trademarks on Osho centers and communes around the world has now come to a legal end.

We would like to congratulate and thank all Osho lovers who supported this cause courageously and our sincere gratitude to Swami Ramteertha, Ma Videh and Swami Chidananda whose undying and sincere efforts has brought this result. Their names will always have a special place in our hearts.

There is still much to achieve to safeguard Osho’s teachings from such conspirators and their associates. Since last two decades a ring of Mafia has not allowed to spread his work freely and his work has suffered globally, but this decision is a landmark achievement and everyone can now share Osho freely on all media and social networks and open meditation centers without any legal fear and threats. Let us now celebrate this great achievement and unite together to free Osho’s legacy.

    Dear Sannyas News,
    To quote bit from your tea table:

    Could not have better expressed my feelings, friends.

    Osho’s legacy, if ever it can be spoken of, like one may speak of a huge library or a real estate property and so on and so more, has ever been in the hearts of people.
    So – following this inner thread, what did hurt me more than anything is when I heard or read that old friends (very old friends) have been “banned”, so to say, from entering the ashram, sometimes also when they got old or sick and the management didn’t like to have them around any more, or other reasons to go in that matter…

    Also the whole legalistic stuff in the regulation and intrigues going on
    (which not only the Cologne centre had to deal with, but which was a climate also here in Munich and yes, made me after a long while hesitant to join the meditation places I know here until I finally dropped going there totally).

    My highlight of today´s caravanserai has been the post of Fresch about being part of Osho’s departure, and what and how she posted that.
    I was present there and then as well – didn´t comment that much, I just said to a friend: “It´s never a question of geography…has never been.”
    That was when I was ‘congratulated’ that I had made it “just in time” to join and come again, after two years. The best I felt was with silent people around,
    that special night, I won´t forget – like so much else.

    So – concerning this post of Arun – we should keep cool, as maybe Lokesh would put it.

      Whenever I hear people talking of a thousand years of some fresh reign, etc, I cannot help remembering the Nazi claim to have instituted a thousand years of a new German empire. That lasted 12 years between 1933 and 1945. Only by an enormous sacrifice of brave and free human lives was that brought to an end, but brought to an end it was.

      Anand Yogi’s diatribe reminds me of a certain Nazi rally speech of 1933!

      But to be serious, I don’t see such a legal judgement by a corrupt and known to be corruptible government being so meaningful.

      As many ‘businesses’ have proved, if one jurisdiction does not suit you, you find another, after of course exhausting all due legal process, which I am sure this decision has not gone through as yet.

        It is perfectly natural for the supporters of the rotten baboons and all westerners who have tried to destroy Osho’s vision to now feel fear at the prospect of the triumphant victory of the forces of true Sannyas.
        These fools only have their minds and egos to fall back on in the face of the onslaught of Truth, but they should remember, minds and egos are as stupid as the people who have them.

        The tide of history is sweeping away the failed fascists and popes of Pune and replacing them with figureheads of true power who will last for a thousand Yugas and many, many generations of lineage of enlightened beings, as clearly stated by Swami Rajneesh and Swami Arun themselves.

        I hurl myself at the feet of these great ones and vow to fulfil their commands and those of our Master at all costs.

            You don’t get it, do you? The copyright affects ordinary sannyasins the most. When it’s free, you can quote Osho on facebook. Other things also, not just like Pune pages, you can quote Osho if you write your life story or want to put some song with Osho quotes on youtube, etc.

            Perhaps all of that will not be of world-class art, but more important is that people will be free to express their source of inspiration. And this era of Islamic censorship by Canadian cult leader will be over.

    There are still miles to go but one thing is worth to study and analyse: widespread discontent and rage against the Jayesh team. It is not an Indian-western issue, but a tussle between disciples and elite disciples.

    There is a saying, “If bald-headed person gets a comb, his head will get the blisters”.
    Without Osho´s shelter around, Sannyas has become one such bald-headed cult.

    That such decisions are likely to be sent for appeal is right in the way system of justice is concerned. In most of such cases in the West, appeal court quite often upholds the decision of the lower court.

    Jayesh and team are on a very bad wicket. More they prolong the legal fight, more skeletons will fall from their cupboards.
    And anyway, they can go up to any level, developed countries’ law machinery delivers swift justice, not like India.

    On a deeper level, it is an irony just like police commissioner’s ons getting caught in gang-style shoot-out.
    All in the name of Meditation!

      Shantam, for someone who claims to have been training in law before he took the robe, you are misinformed. Legal cases in, for example, the UK are often overturned on appeal.

      This is particularly so in asylum case decisions – over 50% of negative decisions are overturned on appeal. Maybe even you, your dear self, benefited from the asylum of Germany or Switzerland, or did your wife do the job?!

    This reminds me a little of the so-called “false Osho will” story of a few months ago. At that time the enemies of Jayesh and Amrito thought they had “got” a result by “proving” that Osho’s will was a claimed forgery, and that the Indian Judiciary and Police were pursuing the matter. Well, here we are some months later and absolutely nothing has happened. No one has been charged, or we would have certainly heard about it from the Shantams of this world.

    Now there is this strange outpouring of so-called “celebration” at a “great victory.” A bit like the end of a war. Well, my prediction is that it is certainly not the end of a war, or even the beginning of the end!
    Just because the Swiss Government, which is indeed a very strange government, who has allowed for years the very rich of the world to hide their affairs and never pay tax in their home countries, and though rich, treat their asylum seekers like dirt, has, for whatever reason, made some decision about the unfitness of the leadership of OIF, does not mean the matter is not subject to appeal or other due legal process. Knowing OIF, it may be just a simple matter of transferring their affairs elsewhere.

      I still haven’t got my head round how they allowed a certain convicted serial poisoner (who was on the run from further trials) to set up and run an old people’s home,with all the chemical and medicinal factors that implies.

    Well, Osho has given us the taste of tantric, freedom of sex mini-society in one of the most sexually repressed countries, India, in Pune 1, a communist mini-society in the most capitalistic country, America, and a capitalistic, elite mini-society only for a few in India again, created by a Canadian (very social- democratic country).

    So PM, from that context, it’s interesting if it will be the Swiss government to destroy the elite sannyas society. These days they (Swiss banks) do that, it happened to some rich people in my country, who were trying to avoid taxes. I think it must have to do something with that if bankers guard criminals, like they did in Malta, other customers disappear. Malta had the Russian dirty money and collapsed. Criminal money can be easy at first, but runs away quickly too. So, Swiss banks are so established, they need to think about their reputation, they do not want criminal customers.

    Interesting, what next? We really are given a social ride on the side of personal enquiry.

    Received a copy of Arun’s letter today. Thought I’d peek in on SN to see how the news is being received. Upon reading my sense is that of fear and left wondering “Is Anand Yogi & Satyadeva for real? Are those sincere expressions?”
    I can’t really tell, as my peeking in the playroom once or twice a year doesn’t really clue me in on the character traits of the current SN crew.

    But I love the surprise! I wasn’t at all expecting fanaticism or conspiratorial fascists…

    Switzerland is no longer the safe haven it once was for dodgy bank accounts. Depositors with something to hide have moved to other, less contolled, offshore banks.

    The only reason the Swiss Government would become involved in such a story is because they see the possibility to make some pocket money. It is business as usual.

    Recall of the Foundation Board –
    enactment of superprovisorische Maßnahmen [immediately enforceable ex parte measures]; initiation of exchange of documents; supervisory measures (Complaint filed 20 May, 2014)

    The Federal Department of Home Affairs (EDI), noting that, whereas:
    • On 20 May, 2014, former member of the Foundation Board, Mr. Robert Doetsch, filed a complaint through the agency of his legal counsel with the Federal Supervisory Board for Foundations (ESA), petitioning that Respondents 2 through 6 should be dismissed from their positions as president, vice president and members of the Foundation Board of Osho International Foundation (OIF). The complaint furthermore petitions that that suitable new board members should be sought and instated for Respondent 1, OIF.
    • It is further petitioned that Respondents 2 through 6 should be dismissed from their positions as president, vice president and members of the OIF Foundation Board without prior hearing, i.e. as a superprovisorische Maßnahme [immediately enforceable ex parte measure], and that a trustee should be appointed to serve until the instatement of the new Board.
    • Then, also as an immediately enforceable ex parte measure, i.e. without prior hearing of the Respondents, the creditors of Respondent 1, in particular the banks Post Finance and Credit Suisse, should be instructed not to pay out or transfer any funds to the Respondents or to other persons until otherwise instructed by the ESA.
    • The right of complaint under foundation legislation is a federal matter, governed directly by Art. 84 Abs. 2 ZGB (Riemer, Berner Kommentar, Die Stiftungen, 1975, N 120 zu Art. 84). The submission of 20 May, 2014 is thus to be treated as a Supervisory Board for Foundations complaint. The Complainant was himself previously a member of the Foundation Board of Osho International Foundation and, having many years of experience and profound knowledge of the material, has a special interest in the preservation and protection of the archives of Osho in keeping with the goals of the Foundation. In particular in the context of his own many years of study and related activities in connection with the teachings of Osho, Robert Doetsch must depend on being able to use the archives of Osho and to continue to have access to the material, both now and in the future. As a beneficiary of the Foundation Robert Doetsch thus has a particularly close relationship with the Foundation and is thus entitled to file such a complaint (BGE 107 II 385 E. 3). The ESA is thus obliged in its official function to make the necessary assessments in the matter (Riemer, Berner Kommentar, Die Stiftungen, 1975, N 121 zu Art. 84 ZGB). Foundation regulation legislation constitutes material public law pursuant to Art. 5 Bundesgesetz [Federal Code] of 20 December, 1968, regarding administrative proceedings (VwVG; SR 172 021) and filing a complaint with the Supervisory Board for Foundations is a legal remedy of administrative justice sui generis, and thus such proceedings are correspondingly regulated by the VwVG (BGE 107 II 385 E. 4).

    • The first matter to be adjudged is the ordering of immediately enforceable ex parte measures. The objective of ordering a preventative measure is the creation or maintenance of a state of affairs that will guarantee the efficacy of the later injunction (BGE 130 II 149 E.2.2). The prerequisite for the ordering of a preventative measure is that there should be convincing grounds for it and that detriment to private or public interests that could not easily be corrected would occur without the ordering of the preventative measure. In addition to this, there must be urgency. Furthermore, the ordered measure must be appropriate. Among other things, a preventative measure serves to protect threatened interests (analogously to Art. 56 VwVG). Such a measure is ordered on the basis of a summary examination of the legal situation and the facts of the matter, for which a credible presentation of facts
is sufficient
    (A. Kölz, I. Häner, M. Bertschi, Verwaltungsverfahren und Verwaltungsrechechtspflege des Bundes, 3.A. S. 198 ff. mit Hinweisen).
    • The Complainant has made a credible case that Respondents 2 through 6 are guilty of serious breaches of the aims of the Foundation, including and in particular continued misappropriation of Foundation assets, the full extent of which cannot yet be fully estimated.
    • Even following extensive research by both the Complainant and the ESA, only a part of an extensive international web of companies and organizations within the purview of OIF has come to light, this web apparently serving the exploitation of the intellectual property rights of OIF and the direction of the resulting proceeds to third parties.
    • In addition to the investigations conducted by the Complainant, investigations by at least three other persons known to the ESA have led to the same conclusions.
    • Against this background, the revised annual financial statements of OIF for 2012/2013 may prove to represent only a fraction of the estimated worldwide income accruing from the intellectual rights to the works of Osho. In its accounts, OIF has been portrayed for years as over indebted, and despite requests by the ESA, the incumbent Foundation Board has failed to implement any sustainable measures for correction of this state of affairs (the letters of subordination submitted regularly by the main creditor, who had a close relationship with the Foundation, cannot be considered to be serious corrective measures in this context).
    • In the course of copyright proceedings in Alicante, Spain, the Respondents submitted a last will and testament of Osho that three independent experts have since assessed to be not authentic. This demonstrates that the Respondents are at least willing to contemplate illegal methods in the pursuit of their aims.
    • If a hearing of the Respondents were to be permitted in advance, too much time would pass and the danger would be greater that actions could be taken that would be to the detriment of the Foundation. Following assessment of the facts of the matter it is realistic to assume that there is a danger that remaining liquid assets could be siphoned off. The risk of asset transfers would also appear to be even greater in view of the fact that in the 2013 financial year, there was an outflow of virtually half of the liquid assets.
    • Thus, the creditors of OIF, specifically the banks PostFinance and Credit Suisse, are to be ordered not to pay out or transfer any funds to the Respondents or other persons until further notice from the ESA. This order applies to a total of three accounts with PostFinance, in Swiss francs, euros and US dollars. At the Credit Suisse it applies to five accounts in Swiss francs, euros, US dollars and Australian dollars, and one account with the designation “STL” (Short Term Loan).
    • It is not currently possible to protect the remaining liquid assets in the bank accounts of the Foundation with less extensive measures.
    • In contrast to this, the protection of the material assets of the Foundation, i.e. in particular the archive of original video and audio recordings and the intellectual property rights to the same, can be sufficiently secured by means of a general restraining order issued by the ESA, accompanied by information on the criminal liability consequences pursuant to Art. 292 StGB in the event of noncompliance.
    • In view of the infringements of the Foundation objectives in question, in particular the misappropriation of financial assets, it is clear that the current Foundation Board must be removed from office until full and complete investigation and clarification of the relevant financial transactions, assets and contracts has been completed. This is particularly important in view of the fact that it is quite possible that the investigations could reveal grounds for criminal proceedings. Against this background, the potential conflicts of interests of the members of the Foundation Board are manifestly clear. The fact that Respondents 2 and 4 are presumably financial beneficiaries of companies that profit directly from the marketing of the intellectual rights to Osho’s works provides ample grounds for a conflict of interests on its own. In addition to this, however, the Respondents also hold executive positions in virtually all known organizations involved in this marketing business. It is thus obvious that if the Respondents were to remain in their positions and offices in the Foundation Board this would at least impede the investigation of these allegations, if not make them completely impossible. It is also absolutely clear that Respondents 2 through 6 must definitely be recalled as Foundation Board members if the apparent infringements of the aims of the Foundation should be proven to be true.
    • The suspension of Respondents 2 through 6 from their positions and functions as members of the Foundation Board of OIF pursuant to Art. 84 Abs. 2 ZGB is the only way to achieve expeditious and complete clarification of the facts of the matter and the legal situation.
    • The appointment of a trustee pursuant to Art. 83d ZGB has the immediate purpose of restoring the Foundation’s ability to act. The duties of the trustee include conducting the investigations needed to clarify the financial and contractual relationships in connection with the marketing of the intellectual property rights, conducting such daily business of the Foundation as cannot be postponed, and, if necessary, also the preparation for the election of new Board members. As is usual in such cases, the details will be regulated by contract.
    • Consequentially, the ESA has sought suitable candidates for this trusteeship and found that Mr. lic. Iur. Andreas G. Keller, attorney, is a suitable choice for the position and fulfills the requirements, and Mr. Keller has immediately declared his willingness to take on the task. The rights and duties of the parties involved were set out in a contract dated 28 May, 2014, based on the general terms and conditions of business (AGB) of the Bund für Dienstleistungsaufträge [Federation for Service Contracts]. The formal appointment of the trustee with authority to sign as a single signatory and his registration in Commercial Register are to be formally ordered by the Supervisory Board for Foundations.
    • Over and above this, no other business operations leading to increasing damage are known and there are no other immediate dangers.
    • The proper exchange of documents is to be initiated simultaneously and the complaint of 20 May, 2014 is to be served to the Respondents by 3 July, 2014, for their response in the main proceedings. The service of the complaint to Respondents 2 through 5 who live abroad is to be effected at the current correspondence address of the Foundation at the offices of their legal representative Dr. Walter H. Meier. Publication of this order in the Schweizerisches Handelsamtsblatt [SHAB Swiss Official Gazette of Commerce] pursuant to Art. 36 VwVG is out of the question in this case. Firstly, this would undermine the purpose of the preventative measures, and secondly it would contravene the legal privacy rights of both the involved persons and OIF.
    • It must be prevented that an appeal lodged against the ordered supervisory measures could cause irreparable damage to the Foundation assets (property) and delay the urgently necessary clarification of the financial situation and future prospects of the Foundation. The suspensory effect of any possible appeal against this order must thus be revoked (Art. 55 Abs. 2 des Bundesgesetzes vom 20. Dezember 1968 über das Verwaltungsverfahren; VwVG; SR 172.021).
    • The ESA expressly reserves the right to issue further orders impacting the proceedings and supervisory measures pursuant to Art. 84a or Art. 83d ZGB.
    • The costs of the proceedings for this intermediate order are set at CHF 4,000.00 and are to be aggregated to the main proceedings, pursuant to Art. 3 Abs. 1 Bst. F Gebührenverordnung Stiftungsaufsicht (SR 172.041.18) and Art. 63 VwVG. 


    Therefore, it is hereby ordered:

    The Federal Department of Home Affairs (EDI), noting that, whereas:

    • On 20 May, 2014, former member of the Foundation Board, Mr. Robert Doetsch, filed a complaint through the agency of his legal counsel with the Federal Supervisory Board for Foundations (ESA), petitioning that Respondents 2 through 6 should be dismissed from their positions as president, vice president and members of the Foundation Board of Osho International Foundation (OIF). The complaint further more petitions that that suitable new board members should be sought and instated for Respondent 1, OIF.

    • It is further petitioned that Respondents 2 through 6 should be dismissed from their positions as president, vice president and members of the OIF Foundation Boardwithout prior hearing, i.e. as a superprovisorische Maßnahme [immediately enforceable ex parte measure], and that a trustee should be appointed to serve until the instatement of the new Board.

    • Then,also as an immediately enforceable ex parte measure, i.e. without prior hearing of the Respondents, the creditors of Respondent 1, in particular the banks PostFinance and Credit Suisse, should be instructed not to pay out or transfer any funds to the Respondents or to other persons until otherwise instructed by the ESA.

    • The right of complaint under foundation legislation is a federal matter, governed directly by Art. 84 Abs. 2 ZGB (Riemer, Berner Kommentar, DieStiftungen, 1975, N 120 zu Art. 84). The submission of 20 May, 2014 is thus to be treated as a Supervisory Board for Foundations complaint. The Complainant was himself previously a member of the Foundation Board of Osho International Foundation and, having many years of experience and profound knowledge of the material, has a special interest in the preservation and protection of the archives of Osho in keeping with the goals of the Foundation. In particular in the context of his own many years of study and related activities in connection with the teachings of Osho, Robert Doetsch must depend on being able to use the archives of Osho and to continue to have access to the material, both now and in the future. As a beneficiary of the Foundation Robert Doetsch thus has a particularly close relationship with the Foundation and is thus entitled to file such a complaint (BGE 107 II 385 E. 3). The ESA is thus obliged in its official function to make the necessary assessments in the matter (Riemer, BernerKommentar, Die Stiftungen, 1975, N 121 zu Art. 84 ZGB). Foundation regulation legislation constitutes material public law pursuant to Art. 5Bundesgesetz [Federal Code] of 20 December, 1968, regarding administrative proceedings (VwVG; SR 172 021) and filing a complaint with the Supervisory Board for Foundations is a legal remedy of administrative justice sui generis,and thus such proceedings are correspondingly regulated by the VwVG (BGE 107II 385 E. 4).

    • The first matter to be adjudged is the ordering of immediately enforceable ex parte measures. The objective of ordering a preventative measure is the creation or maintenance of a state of affairs that will guarantee the efficacy of the later injunction (BGE 130 II 149 E.2.2). The prerequisite for the ordering ofa preventative measure is that there should be convincing grounds for it and that detriment to private or public interests that could not easily be corrected would occur without the ordering of the preventative measure. In addition to this, there must be urgency. Furthermore, the ordered measure must be appropriate. Among other things, a preventative measure serves to protect threatened interests (analogously to Art. 56 VwVG). Such a measure isordered on the basis of a summary examination of the legal situation and thefacts of the matter, for which a credible presentation of facts is sufficient
    (A. Kölz, I. Häner, M. Bertschi, Verwaltungsverfahren und Verwaltungsrechechtspflegedes Bundes, 3.A. S. 198 ff. mit Hinweisen).

    • The Complainant has made a credible case that Respondents 2 through 6 are guilty off serious breaches of the aims of the Foundation, including and in particular continued misappropriation of Foundation assets, the full extent of which cannot yet be fully estimated.

    • Even following extensive research by both the Complainant and the ESA, only a part of an extensive international web of companies and organizations within the purview of OIF has come to light, this web apparently serving the exploitation of the intellectual property rights of OIF and the direction of the resulting proceeds to third parties.

    • In addition to the investigations conducted by the Complainant, investigations by at least three other persons known to the ESA have led to the same conclusions.

    • Against this background, the revised annual financial statements of OIF for 2012/2013 may prove to represent only a fraction of the estimated worldwide income accruing from the intellectual rights to the works of Osho. In its accounts,OIF has been portrayed for years as over indebted, and despite requests by the ESA, the incumbent Foundation Board has failed to implement any sustainable measures for correction of this state of affairs (the letters of subordination submitted regularly by the main creditor, who had a close relationship with the Foundation, cannot be considered to be serious corrective measures in this context).

    • In the course of copyright proceedings in Alicante, Spain, the Respondents submitted a last will and testament of Osho that three independent experts have since assessed to be not authentic. This demonstrates that the Respondents areat least willing to contemplate illegal methods in the pursuit of their aims.

    • If a hearing of the Respondents were to be permitted in advance, too much time would pass and the danger would be greater that actions could be taken that would be to the detriment of the Foundation. Following assessment of the facts of the matter it is realistic to assume that there is a danger that remaining liquid assets could be siphoned off. The risk of asset transfers would also appear to be even greater in view of the fact that in the 2013 financial year, there was an outflow of virtually half of the liquid assets.

    • Thus,the creditors of OIF, specifically the banks PostFinance and Credit Suisse, are to be ordered not to pay out or transfer any funds to the Respondents or other persons until further notice from the ESA. This order applies to a total of three accounts with PostFinance, in Swiss francs, euros and US dollars. At the Credit Suisse it applies to five accounts in Swiss francs, euros, US dollars and Australian dollars, and one account with the designation “STL” (Short TermLoan).

    • It is not currently possible to protect the remaining liquid assets in the bank accounts of the Foundation with less extensive measures.

    • In contrast to this, the protection of the material assets of the Foundation, i.e.in particular the archive of original video and audio recordings and the intellectual property rights to the same, can be sufficiently secured by means of a general restraining order issued by the ESA, accompanied by information on the criminal liability consequences pursuant to Art. 292 StGB in the event of noncompliance.

    • Inview of the infringements of the Foundation objectives in question, in particular the misappropriation of financial assets, it is clear that the current Foundation Board must be removed from office until full and complete investigation and clarification of the relevant financial transactions, assets and contracts has been completed. This is particularly important in view of the fact that it is quite possible that the investigations could reveal grounds for criminal proceedings. Against this background, the potential conflicts of interests of the members of the Foundation Board are manifestly clear. The fact that Respondents 2 and 4 are presumably financial beneficiaries of companies that profit directly from the marketing of the intellectual rights to Osho’s works provides ample grounds for a conflict of interests on its own. In addition to this, however, the Respondents also hold executive positions in virtually all known organizations involved in this marketing business. It is thus obvious that if the Respondents were to remain in their positions and offices in the Foundation Board this would at least impede the investigation of these allegations, if not make them completely impossible. It is also absolutely clear that Respondents 2 through 6 must definitely be recalled as Foundation Board members if the apparent infringements of the aims of the Foundation should be proven to be true.

    • The suspension of Respondents 2 through 6 from their positions and functions as members of the Foundation Board of OIF pursuant to Art. 84 Abs. 2 ZGB is the only way to achieve expeditious and complete clarification of the facts of the matter and the legal situation.

    • The appointment of a trustee pursuant to Art. 83d ZGB has the immediate purpose of restoring the Foundation’s ability to act. The duties of the trustee include conducting the investigations needed to clarify the financial and contractual relationships in connection with the marketing of the intellectual property rights, conducting such daily business of the Foundation as cannot be postponed, and, if necessary, also the preparation for the election of new Board members. As is usual in such cases, the details will be regulated by contract.

    • Consequentially,the ESA has sought suitable candidates for this trustee ship and found that Mr.lic. Iur. Andreas G. Keller, attorney, is a suitable choice for the position and fulfills the requirements, and Mr. Keller has immediately declared his willingness to take on the task. The rights and duties of the parties involved were set out in a contract dated 28 May, 2014, based on the general terms and conditions of business (AGB) of the Bund für Dienstleistungsaufträge [Federationfor Service Contracts]. The formal appointment of the trustee with authority to sign as a single signatory and his registration in Commercial Register are to be formally ordered by the Supervisory Board for Foundations.

    • Over and above this, no other business operations leading to increasing damage are known and there are no other immediate dangers.

    • The proper exchange of documents is to be initiated simultaneously and the complaint of 20 May, 2014 is to be served to the Respondents by 3 July, 2014,for their response in the main proceedings. The service of the complaint to Respondents 2 through 5 who live abroad is to be effected at the current correspondence address of the Foundation at the offices of their legal representative Dr. Walter H. Meier. Publication of this order in the SchweizerischesHandelsamtsblatt [SHAB Swiss Official Gazette of Commerce] pursuant to Art.36 VwVG is out of the question in this case. Firstly, this would undermine the purpose of the preventative measures, and secondly it would contravene the legal privacy rights of both the involved persons and OIF.

    • It must be prevented that an appeal lodged against the ordered supervisory measures could cause irreparable damage to the Foundation assets (property) and delay the urgently necessary clarification of the financial situation and future prospects of the Foundation. The suspensory effect of any possible appeal against this order must thus be revoked (Art. 55 Abs. 2 desBundesgesetzes vom 20. Dezember 1968 über das Verwaltungsverfahren; VwVG; SR172.021).

    • The ESA expressly reserves the right to issue further orders impacting the proceedings and supervisory measures pursuant to Art. 84a or Art. 83d ZGB.

    • The costs of the proceedings for this intermediate order are set at CHF 4,000.00and are to be aggregated to the main proceedings, pursuant to Art. 3 Abs. 1Bst. F Gebührenverordnung Stiftungsaufsicht (SR 172.041.18) and Art. 63 VwVG.

    Well, my beer of today came from a company which goes back in tradition of beer manufacturing to 1636; that was kind of refreshing because summer time and summer temperatures are coming into full gear these days.

    has invited me to go for a special pain-killer or -smoother.

    Yet there is the love and gratefulness that we met or meet around a MYSTIC, being quite often in awe about the fact, how multi-coloured in every dimension His bunch of people are, aren´t we?

    Takes quite a long time –
    if ever -
    to find our own voice for it to express the love and gratefulness as well as what we might be up to share with others.

    Restrictions can also be seen or understood as a challenge, either to keep silently waiting till some seed is coming out by itself – so – not to force it – more like a good gardening,
    or taking the challenge of ‘not-knowing’ at all – with some so-called implications of giving up the hope to be acknowledged or rewarded or whatsoever in this direction (a full blast trap, the latter).

    So – there is a lot of fresh air, Fresch, to breathe – in between just these options – and these are only two, there might be so many others…

    I am reminded just now, I don´t know why, of a very, very old AIKIDO MASTER,
    who honoured us (an audience) decades ago in the Senkenberg Museum, Frankfurt, Germany, a museum where you are in midst of the skeletons of dinosaurs and whatnot – such huge skeletons.

    There he was, this tiny-looking man, looking as fragile as can be.
    He invited men from the audience with all their muscle power to kick him off the stage.
    Sure enough, men came on stage, like men whose counterfeit (MOD: MEANING, PLEASE, MADHU?!) with muscle packets every advert of a fitness muscle club would be very proud of to have as its models.

    I will never forget how this small man, just using his tiny fingers,
    threw one after the other of these muscle heroes off the stage.

    Then He bowed down to all of us and disappeared.

    This event I had been able to join, was ages and ages ago,
    yet it gave me a lesson that is unforgettable.
    I am not into aikido myself,
    but the lesson about power,
    being empowered or being deprived of power and so on,
    this lesson is alive when I recall it.

    Thank you for reminding me of this, the way it happened through you.

    First try:
    What I saw is that this being used the energy of forces opposing Him.
    instead of fighting it on the level (strong body power) it came towards him in a (seemingly ) hostile way.
    Second try:
    He was plugged into a source deep inside as so broad outside too
    and beyond his personality – just like an empty mirror Himself, throwing back indeed the picture (and the reality) too of the oppose.
    Third try:
    We merely see what real forces are destining the ‘leela’ of you-and-me-and-the whole.

    It´s a lifelong growing to become more aware of this.

    And if you, moderators, want a better try (explanation), better to talk to some aikido practitioner or go just to watch it yourself, like I did , years and years ago.
    I have been sorry that because of very bad back conditions of mine, I never dared to join the practice.

      I have to say that I was interested in these kinds of displays of power by martial arts masters and my observation on the matter is that these kind of displays can and do not happen for example, in riots or surprise attacks by strong and violent people (except in kungfu movies), they happen in situations that have an implicit choreography, typically, as in the example given by Madhu, in the master’s dojo.

      That is to say, they are ‘set-up’ .There may be some spontenaiety but it is a ‘controlled accident’.

      Those guys didn’t just come in and attack the place with intent to rob, kill or capture the place, did they? Or the master didn’t wander as a stranger into a favela or ghetto run by A hungry gang.

      Thus, degrees of expectation and the matter of suggestion on the part of the players participating in the ‘leela’ have to be taken into account.

      The ‘Indian rope trick’ has the reputation of being the greatest magic trick ever.
      Yet, not only are the accounts of it by those who claim to have seen it confusing, very tellingly it has not survived into the video age.

      This fact alone suggests very strongly,if not proves, that the Indian rope trick was not an actual prestigitation procedure like, for example a more complicated version of pulling a dove out of a hat.

      rather, the magic trick itself was to create the idea in people all over the world that something that had only ever existed in the mind was completely real. In this they were wildly successful, and any doubts you have about my version of events testifies to the success of that trick!

          Arps, it all has to do with being identified with oneself. If you are identified in such a way, no growth in awareness is possible. Therefore it is unlikely in this case that anything new will happen. Like putting a cd deck in loop. It will go until the juice eventually runs out.

But there is in fact a narrowness happening if one is into willpower and eager to get something. That´s what I wanted to make clearer.

    The men who appeared on stage had been in that mood; a mood I often know myself, it´s the mood of wanting something so badly.

    yet I want to add that the event I remembered was not a `closed` dojo happening.
    But I know by traumatic experiences that you are right (the first chapter of your post at 9.10 pm).

    The truth is, though, that I sometimes feel the need of a remembering of such a such-ness, to keep going, especially when in longtime extremely uncomfortable surroundings and also being quite isolated.

    Then and there I sometimes use these remembrances as a ´gardening essence`, you can say.

      Of the many distasteful personality characteristics that El Chudo displays on SN I find conceit to be the lynch pin. I also wonder why he sets himself up as the receptor for so many negative comments directed at him. In the long run these comments, which leave an imprint on the unconscious, will bubble up and severely damage his self-esteem.

      It is the same old story. People love negativity in all its myriad forms because it feeds the negative emotions that they are so addicted to. Nothing new there.
