Osho’s Will revealed after 23 years…

The dispute over trust properties between rival factions of Osho’s followers has taken an extraordinary turn with the faction controlling Osho’s properties producing a purportedly certified copy of Osho’s will, 23 years after his death.  Osho died in Pune on January 19, 1990 and there was no mention of any will left behind by Osho in the press conferences held by the Osho trustees following his death.

Now, 23 years after his death, the document presented as Osho’s will has suddenly surfaced during  Court proceedings in the European Union. Osho’s followers in India were alerted to this development in June, 2013. This will signed by Osho has now been challenged in a Pune court as a forged will and the case before Civil Judge (Junior Division) U.L. Pathak is slated to come up for hearing on September 24. The will dated 16 June 1989 bearing Osho’s signature states that he is bequeathing all properties in his name, including ownership and publishing rights to the Neo Sannyas International Foundation, a Swiss charitable trust. Signed on a stamp paper of Rs10, Michael O’Byrne (Swami Anand Jayesh), president of Osho Foundation International, Zurich, has been identified as the executor of the will and two other foreigners, who are members of this Foundation, as the witnesses, namely, witnesses John Andrews (Swami Amrito) and Philip Toelkes (Swami Prem Niren). The petitioners Osho Friends Foundation & Others led by Yogesh Thakkar alias Swami Premgeet and Kishor Raval alias Swami Prem Anadi who have challenged the authenticity of the will have charged Michael O’Byrne, John Andrews and Philip Toelkes of forging the document and have urged the court to declare the will as null and void. They have also urged the court to permanently restrain the trustees from implementing the will and have also appealed for appointment of an administrator for safe custody of Osho’s properties which includes real estate and intellectual properties running into crores of rupees.

Thakkar said if the authenticity of this will is allowed to go unchallenged, it would mean that properties of Osho belonging to India would now go out of the country. The others named as respondents in the petition are prominent Osho trustees and NRI, Mukesh Sarda (Swami Mukesh Bharti), Vidya Khubchandani (Ma Vidya Bharati) and the Neo Sannyas Foundation. Thakkar and his co-petitioners already have two suits pending against in the Bombay High Court against the administrators of Neo Sanyas Foundation aka Rajneesh Foundation and Osho International Foundation and their trustees for alleged fraud of Rs300 crore, manipulation and embezzlement of Osho trust properties.

The petitioners have alleged that the Foundation trustees “are transferring funds, assets, and benefits of the Osho charitable trusts in favour of private limited companies” controlled by them. According to the petitioners, Osho has left behind a “colossal legacy” which includes archives of 9,000 hours of audio discourses in Hindi and English, 1,870 hours of video discourses, 650 titles of transcribed books in Hindi and English which are being translated in 65 languages around the world, about 850 paintings by Osho, 80,000 books in Osho’s personal library at his commune in Koregaon Park which contains his notations, Osho’s Samadhi at Koregaon Park, and prime real estate in Pune and elsewhere valued at more than Rs. 1,000 crore.

The petitioners have argued that “non-production of Osho’s will for 23 years, comprehensively proves that no such will or document ever existed.” They have also pointed out that Rajneesh’s name in the will is stated as “Chandra Mohan Jain” when in fact his birth name was “Rajneesh Chandra Mohan”. The text of the will dated 16 June, 1989, running into five paragraphs states as follows: RECITAL: “In 1975, 1978 and 1981, I executed assignments concerning my work. Also, in 1981, I executed a broad power of attorney will the stated intention to divest myself of all worldly property, and also an amendment in 1982, with the result that all such property is now owned by Neo Sannyas International Foundation, a Swiss charitable entity. To be completely certain that all such property interests are so divested, I make this Last Will and Testament.

OSHO’S  LAST WILL & TESTAMENT:  Being of sound mind, and acting of my free will, I make this Last Will and Testament. I, Osho, birth name Chandra Mohan Jain, formerly known as Bhagwan Shree Rajneesh, hereby devise and bequest any and all right, title or interest of any nature in any and all property of any nature and in any form, owned by me, now or in the future, including but not limited to, all ownership, publishing or related rights, to all my work, published to date or in the future, in any form, to Neo Sannyas International Foundation. If for any reason that entity cannot or does not accept this bequest then the alternate beneficiary shall be a non-profit, charitable entity dedicated to the dissemination of my work, such entity to be designated by my executor. EXECUTOR: I name as my executor Sw. Anand Jayesh, aka Michael O’Byrne. Executed this 15th day of October, 1989, at Poona, India.

      Jesus was sold out for 30 copper coins, not silver ones. What does it matter? Judas tossed the coins away in disgust before hanging himself. The passion of Christ is a far more interesting story than legal battles over who owns what of what Osho left behind. Personally I’m not in the least bit interested.

    Any way, I am not surprised to create sham marriages for visa and resident purposes was part of Sannyas tradition, all on ten rupees stamp paper duly stamped by the notary.
    I think in 1989, notary was also charging 10 rupees, and without parties available, it was 50!

        Maybe not so much for those who were there, but perhaps for Humanities future. It could be part of a further manipulation, same as probably installed on Moses, Buddha, Jesus and Mohammed. How otherwise “Love” could be result a society, which leads people into hostility against the own kind.

    I know both the sides quite closely. Individually, all are remarkable people, unfortunately, both the sides have become the washer man’s wives!

    It is not always bad people, the demons. Mythology has the stories where angels bleed each other to death, samurai piercing the chest of each other.

    Seems like Osho is the master who triggered maximum amount of natural morphine into the blood.
    Look at my life. It has become socially useless because of such intoxication. Thanks heaven, I am still in senses not to enter neighbour´s house and jump on his wife!

Greed has taken over through-out the world..and greed is journey to spiritual disaster..the inner journey becomes dead for those on the greed trip..it is sad- for these old sannyasins..on that journey….but their time for transformation will just have to wait for the next lifetime…being the ordinary man ..being one’s self here and now..and just enjoying whatever Existence delivers…is avoiding what ever the society has programmed all to be and want…and allowing one self to live in each moment relaxed… being spontaneous can be a better path for the awakening to ones’ true essence ..the no-self..beyond the mind..eternal oneness or not twoness..

                  What I’m getting at is the West, in its all-consuming worship of what one might call intellectual materialism, has promoted self-serving greed on a scale unparalleled in known history, to become the dominant motivating force of its culture, which now of course spans and includes the entire human race. Hence the obsession with ‘growth’ – economic, rather than psycho-spiritual.

                  Its science and technology have primarily served, and still largely serve that end, whereas other cultures – now pretty well extinct (including being killed off by the aggressively ‘enlightened’ West) or redundant – have tended to nourish a more profoundly spiritual orientation, including a deeper connection to the natural world – as well as containing the usual spectrum of ‘evils’ created by human ignorance.

        Hi Dom, I find all this Osho legacy number utterly uninspiring plus I’m working a lot as a DJ with a lot of high-powered night life. Played to a good crowd last night until dawn. A lot of sannyasins showed up so a good time was had by one and all. The Osho quote was used because he was speaking about ‘will’ power. A weak joke in the current context.

    Just as the followers of Mahavir, Gautam Buddha & Jesus twisted their (Master’s) teachings, the same or even worse is happening now with the followers of Osho. What an irony that all the so called Swami’s (Followers/torch bearers of Osho) who are fighting/claiming his property are the ones who have missed HIS (Osho’s) point.
    I am sure Osho would be seeing and laughing at the stupidity of his followers!

    just the other day, I was rooting around in my garden shed,looking for something I`d lost, when I came across one of those old 10 rupee aerogrammes.
    as I opened it up and read it,blimey! it turned out to be osho`s will!
    fancy that!
    I`d completely forgotten about it!
    well, that’s just the old going-beyond-the mind beginning to kicking in,i suppose.
    well,i have been meditating for a few decades now,after all..

    it is dated December 10th,1989
    anyway,it read:

    Notice the perfection in Osho’s bald-headed dome,which is very well complimentated by his black beard.
    Luckily I have managed to come across a large collection of these photo’s in an auction and am selling these qaulity prints for rupees 10 per piece.

    I have heard a rumour that the Will document is not working out, so another document is about to float upon the world proving that Osho adopted Jayesh as his son. Now when did we hear that one before…. 1983 or 4 when some cock and bull story was concocted to prove that Osho was adopted, I think into Sheela’s family when he was a child or some such. Maybe someone here knows the story more precisely than my memory allows? It was about finding a way so Osho could stay in the States legally as I remember, but not sure of the connection?

    Osho in the handcuffs During His last days in America adevnture. there are two other gentlemen with. One is his doctor and another a totally new comer.

    Swami Satya Vedant, an erstwhile member of the inner circle, expressed dismay . “It is highly unlikely, that any will made by Osho will be entrusted on them,” he asked.

        thanks Arps for the suggestion. Yes it does seem strange given the reaction they must have known would follow.
        Niren always struck me as one of the more sane people around the Ranch debacle, and a trained lawyer to boot. He is not part of the Ashram elite anymore, I think he may even work as a lawyer again in the US. Guess someone could ask him as he is listed as a witness?
        The other two “chaps” have both had some question marks placed against their “stability” as people, so it could be some sort of madness being provoked in them as they struggle to win a fight they do seem to be losing. … ..

    I hope future of spiritual organisations will remember the no so golden recent past.

    This so called will is a desperate attempt, almost like chemical weapons.
    They seems to be falling in their own trap and also putting the question mark on Osho’s creditibility.
    Jayesh and Amrito seems to be the masters of forgery and taking law in their own hand.
    I can imagine these two people’s energy was also a triggering point for Nirvano’s untimely death, most often suicide. No police report, no postmartom, no press; but now they seem to be running out of ammunation!

      Idle talk of these two men’s “energy” is simply that; moreover, you didn’t know the woman so you have no clue of the effect of anyone on her, at any time, do you?

    Few things we know from news papers, for few things we can be eye witness or on the same space where drama was unfolding.

    Surely it is a hear say for me, when i have read in the newspapers about a statement of Bill Clinton about Hillary. It is mentioned by his ex. mistress. In an exclusive interview to daily mail she has said, ” Bill thought Hillary was a bisexual, and he feels happy to know that she has eaten more Puxxy than him.”

    but when i write about the scenes of dramas happened after Osho’s arrival to Pune, most often i know the characters and their shadows.
    When you spend your life in an ocean, even as a frog you encounter amazing amazing mind blowing stories.
    This is one of the reason, to save their peace of mind, many frogs go back to their ponds!

    In liablity cases too, owner of the vehicle is held responisible for driver’s mistakes. If not for criminal negligence, atleast for monatary conpensation.

    Does; “purportedly certified” mean the original seller with independent
    documentation has been found?

    Is the court being asked to rule on the will on its own?

    (Personally I have little interest in the wrangling over Osho’s legacy.
    But I would find it ironic if a fake! were to scupper swami R’s dream of resort domination.)

      “Purportedly certified’ simply means that Osho International are “claiming” that the will is independently verified and in the way you document. Of course this does not mean such certification will reach the Court’s standards, or forensic examination!

      Presuming and assuming guilt before you or anyone, not to mention a court, has precise details of the evidence and has thoroughly examined them.

      As such, it’s an extremely poor example to set for your own ‘followers’ (or “friends”, or whatever you call them).

      Just more trickily reckless, unprincipled politicking, on similar lines to your publically assuming Osho was murdered or unlawfully killed by the same people.

    Osho may have said, ” It is good. Just buy the cheapest ones. I don’t like to waste money on government papers.”
    Therefore it was decided to buy 10 rupees stamp paper. The cheapest ones.

    Typist must have taken too around 15 rupees and notary maximum 50, because Gora(White) people were in a hurry for his signature.
    And a new history has been created, “How the greatest master after Gautama the Buddha handed over, ” The Transmission of Lamp.”

    Is it not a matter of embarrassment?

      You might wish it were otherwise, but since when was Osho’s movement ever ‘respectable’? It’s been up to its neck in controversy, shady dealing and worse for decades.

      Wake up, get real, Shantam. This wish to be seen as ‘whiter-than-white’ by the world is, in its way, almost as corrupt as the alleged ‘crime’ you’re enjoying condemning.

      If you mean to include me in the category you outline in your first paragraph, Shantam, then I should tell you that it’s not a matter of ‘seeing the good in everybody’ etc., it’s more impersonal than that nonsense, it’s simply a question of standing up for a basic principle of justice.

      Perhaps you prefer to align yourself with those who give prime value to hearsay, rumour, innuendo and their natural outcome, when unchecked, the rule of the selfishly emotion-driven, wilfully unintelligent, unprincipled mob? (Amongst which, even certain of the ‘enlightened’ – well, one anyway – are numbered, it appears).

    Mostly the written expressions create some kind of thoughts in readers. So when I read something, few words simply take the form. This is nothing extra ordinary, if we know how to write, it is easier than to formulate the feelings in words.

    So with this background, I wish to say, I have not included Satya Deva in my post about goody goody people. If words are the indications, he is one of the most balanced writer at this site. Surely he has his own limitations in vision like all of us, including those past present and future enlightened ones and so called one, who think themselves as navel of the world.
